Solicitors have a responsibility to advise their clients on the various funding options available in relation to legal work and to consider which is most appropriate for each case. Choice, as ever, brings with it complexity. Each available option has advantages and disadvantages and these have to be weighed up against the possible outcomes of the case. It may be appropriate to fund different parts of the case in different ways. We will consider and advise you in this respect. We will also consider whether the case is likely to be justified on a cost benefit analysis. We will agree clear and transparent payment terms with you. If we can, we will give you an estimate for all the work on your case. Where appropriate we will agree ‘stage limits’ with you which will not be exceeded without your prior authority. You can then consider the progress made at the end of the stage before deciding how to proceed. We will examine with you the orders the court may make with regard to the costs of the case. This includes the effect of an order for costs in your favour but also a possible order against you. We can advise on whether insurance might be obtained to guard against the consequences of a substantial financial burden in the event of the unsuccessful outcome of the proceedings. |
